Negotiating Team for the SMEI trilogue
The third trilogue on the proposal for a Regulation establishing the single market emergency instrument and repealing Council Regulation No (EC) 2679/98 was held on 7 December 2023. The EP Rapporteur is Mr Andreas Schwab (EPP). The proposed new regulation aims to ensure unhindered flow of essential goods and workers even when countries have to resort to movement restrictions and border closures. The next trilogue is scheduled for 1 February 2024.

At the trilogue of 7 December, the co-legislators discussed a number of issues in a constructive spirit, but the divergences between the co-legislators, specifically on provisions related to priority rated orders, fast lanes, digital forms for workers and the Parliament's role in the activation of the emergency mode remain.

Mr Schwab said: "Unfortunately, no agreement could be achieved. The Council does not want to accept even the measures that were applied during the COVID-19 crisis''.
